Client Agreement and Referral Fee Policy for Nanny Services

American Nanny & Family Care Services LLC is a referral and placement agency. Signing this agreement and receipt of the required processing fee is necessary before arranging any childcare provider (here after referred to as, Nanny) interviews. This agreement contains the entire agreement between the parties with respect to any Nanny services offered by American Nanny & Family Care Services LLC and supersedes any and all agreements and understandings between parties with respect to such services and all related matters. This a New Hampshire contract and shall be governed and construed in all respects in accordance with the laws of the State of New Hampshire, without regard to the conflict of laws principles thereof.

Client and Nanny are responsible for all City, State, and Federal reporting requirements set forth by law. This agency abides by the directives set forth in the Equal Opportunity Laws with regard to discrimination based on race, color, religion, sec or national origin.

American Nanny & Family Care Services LLC referral specialists and affiliates conduct personal interviews with every Nanny candidate. An agent of this service will interview all Nanny candidates personally and have reference checks reviewed with regard to places of employment, education, and personal character. Nannies may have their drivers’ license, credit bureau report, and a nationwide criminal record searched. All information obtained about a candidate is available to the prospective employer. It is understood that some information is not obtainable and will not be included in the final report. Client and Nanny will make the final decision to accept or deny a placement. American Nanny & Family Care Services LLC and its agents cannot be held responsible for Nanny’s past, present or future conduct. Client agrees to not contact previously referred Nanny candidates within two years of the referral. Client agrees to not share the names or phone numbers of Nannies referred by this agency.

Fees:

• Application Processing Fee: $175.00 will be sent to the agency before any interviews can be arranged between client and Nanny candidates. Fax agreements are valid. Processing fee is non-refundable. If Nanny discontinues service in the second year, a processing fee will not be expected. When a new nanny is found the following fees and conditions will be incurred.
• Agency placement fees: $875.00 Live-out (NH) $800.00 Live-out (MA VT ME)

$950.00 Live-in (NH) $850.00 Live-out (MA VT ME)

• Client agrees to pay all placement fees to this agency in the event that a Nanny is hired.
• Agency fees are due one week after a Nanny has been selected, has agreed to a start date for the position, and is no longer available for further interviews with other clients. If payment to the agency is not received before the first work week of the Nanny, this agency holds the right to stop Nanny care services and/or sent the Nanny on interviews with other clients.
• A late fee: $10.00 per day will be billed if Nanny begins service before the agency has been paid.
• Annual Renewal Fee: Nanny care services are reviewed yearly for each client family. If nanny will continue care for the next year and is therefore unavailable for the agency to place with another family, the client will be charged $775.00

American Nanny & Family Care Services LLC agrees to do our best in locating the Nanny that closely matches the needs of our client families. We agree to keep confidential information regarding our clients. We will continue to offer Nannies the opportunity to improve the quality of care through programs offered at this agency and our affiliations. It is recommended that the client and Nanny sign an agreement between themselves describing the details of service. Such an agreement is the sole responsibility of the signers and not this agency of any of its agents.
